Terms of service
Last updated: September 28, 2026
OVERVIEW
Welcome to Emberena. Emberena is a brand operated by Jiangxi Sinotrade Through International Logistics Ltd. The terms “we,” “us,” and “our” refer to Emberena and its operating company.
We operate this store and website, including all related information, content, features, tools, products, and services offered to you (collectively, the “Services”). Our store is hosted and powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.
These Terms of Service, together with any policies referenced in them (collectively, the “Terms”), explain your rights and responsibilities when you access or use the Services.
Please read these Terms carefully. They contain important information about your legal rights, including disclaimers and limitations of liability.
By accessing, using, purchasing from, or otherwise interacting with the Services, you agree to these Terms and our Privacy Policy, available at https://emberena.com/policies/privacy-policy. If you do not agree, you should not access or use the Services.
SECTION 1 — ACCESS AND ACCOUNTS
By agreeing to these Terms, you represent that you have reached the age of majority in your state, province, or jurisdiction of residence, or that you have reached the age of majority and have authorized any minor dependent under your supervision to use the Services.
To browse our store, create an account, use customization tools, or purchase products, you may be required to provide information such as your email address, billing details, payment information, shipping address, photographs, names, dates, and other personalization details.
You represent and warrant that all information you provide is accurate, current, and complete and that you have all rights and permissions necessary to provide it.
You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.
SECTION 2 — OUR PRODUCTS
We make reasonable efforts to display and describe our products accurately. However, colors and product appearance may vary depending on your screen, device settings, lighting, printing processes, paper texture, natural wood grain, and other material characteristics.
Minor differences between a digital preview and the finished product, including reasonable variations in color, crop, texture, wood grain, and placement, are not necessarily defects.
Natural oak frames may vary in grain, tone, and pattern. Fine art paper may have subtle variations in texture. Product images and room mockups are illustrative and may not represent exact physical scale.
Products are personalized and made to order. We may use third-party printing, framing, fulfillment, technology, and shipping providers, including production and fulfillment partners located in the United States, to complete and deliver orders.
Product descriptions, specifications, availability, and pricing may be updated from time to time. We may discontinue or limit products where reasonably necessary, subject to orders already accepted and applicable law.
Nothing in these Terms limits warranties or consumer rights that cannot legally be excluded.
SECTION 3 — PERSONALIZATION, CUSTOMER CONTENT, AND PROOF APPROVAL
“Customer Content” includes photographs, names, dates, text, messages, designs, instructions, and other content you upload, enter, submit, or approve through the Services.
You retain ownership of your Customer Content. By submitting Customer Content, you grant Emberena and our service providers a non-exclusive, worldwide, royalty-free, limited license to store, access, reproduce, crop, resize, adjust, transmit, print, frame, package, and otherwise process that content solely as reasonably necessary to provide the Services, produce your order, provide customer support, prevent fraud, and comply with law.
You represent and warrant that:
- • You own the Customer Content or have all necessary rights and permissions to use and submit it
• Our use of the Customer Content to fulfill your order will not infringe any copyright, trademark, privacy, publicity, personality, or other rights
• You have appropriate permission from every identifiable person shown or named in the Customer Content
• If Customer Content includes a photograph or personal information relating to a child, you are the child’s parent or legal guardian or have valid authorization from the parent or legal guardian
• The Customer Content is lawful and complies with these Terms
Customers are responsible for checking names, dates, spelling, wording, photographs, crop, image placement, orientation, layout, size, format, frame selection, and other personalization details before submitting or approving an order.
If the online customization tool provides a final preview before purchase, submitting the order constitutes approval of that displayed design.
If a separate proof is sent after purchase, production will begin only after the proof is approved. Once approved, the customer accepts the displayed content, spelling, image placement, layout, size, and design.
We may contact you if we identify an obvious file or image-quality problem. However, we are not responsible for errors or quality limitations contained in Customer Content that you submitted or approved.
We may reject or cancel an order containing Customer Content that we reasonably believe is unlawful, infringing, threatening, abusive, exploitative, discriminatory, hateful, sexually explicit, obscene, deceptive, or otherwise inappropriate. If an order is canceled before production for this reason, we will refund the amount paid for the canceled product, except where prohibited by law or where fraud or unlawful conduct is involved.
SECTION 4 — ORDERS
Submitting an order is an offer to purchase. An order becomes accepted when we send an order confirmation, successfully process payment, and do not subsequently reject the order for fraud, availability, technical, legal, production, or personalization-related reasons.
Please review your order carefully before submitting it. Because products are personalized and made to order, changes or cancellations may not be possible after approval or production has started.
If we reject, change, or cancel an order, we will make reasonable efforts to contact you using the information provided during checkout.
Returns, replacements, cancellations, and refunds are governed by our Return & Refund Policy, available at https://emberena.com/policies/refund-policy.
Unless we expressly agree otherwise in writing, products are sold for personal or household use and not for commercial resale or export.
SECTION 5 — PRICES, BILLING, AND PAYMENT
Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when the order is submitted, subject to correction of obvious errors.
Unless expressly stated otherwise, displayed prices do not include applicable taxes, shipping charges, handling fees, duties, or other charges that may be displayed at checkout.
You agree to provide accurate, complete, and current billing, payment, contact, and account information.
You represent and warrant that you are authorized to use the payment method provided and that the payment information is accurate. You authorize us and our payment service providers to charge the applicable order total, including taxes and shipping charges shown at checkout.
We may cancel or limit an order where reasonably necessary to address suspected fraud, unauthorized payment, pricing errors, product unavailability, prohibited Customer Content, or other legitimate business or legal concerns.
SECTION 6 — SHIPPING AND DELIVERY
Production and delivery estimates are provided for convenience and are not guaranteed unless we expressly confirm a guaranteed service in writing.
Personalized products require production time in addition to carrier transit time. If proof approval is required, production timing begins only after approval.
We may use third-party production and shipping providers and carriers including USPS, FedEx, UPS, or other suitable services.
We remain responsible for addressing verified loss, damage, incorrect products, or other fulfillment problems in accordance with our published policies and applicable law. Risk is not transferred in a way that removes any non-waivable consumer rights.
Customers are responsible for providing a complete and accurate shipping address. Address changes are not guaranteed after production or fulfillment preparation has started.
Our complete shipping terms, estimated timeframes, tracking procedures, and lost-package process are provided in our Shipping Policy at https://emberena.com/policies/shipping-policy.
SECTION 7 — INTELLECTUAL PROPERTY
The Services and their content, including our trademarks, brand elements, text, graphics, images, videos, templates, layouts, product designs, artwork, website design, selection, and arrangement, are owned by or licensed to Emberena and are protected by applicable intellectual property laws.
These Terms permit you to use the Services only for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, sell, license, or commercially exploit our materials without prior written permission.
Purchasing a physical personalized product does not transfer ownership of Emberena’s templates, artwork, layouts, design systems, trademarks, or other intellectual property and does not grant a commercial reproduction license.
You retain your rights in original Customer Content, such as photographs you submit, subject to the limited license granted in Section 3.
“Emberena,” our logos, product names, designs, and slogans are trademarks or brand assets of Emberena or our licensors. Shopify’s names, logos, product names, designs, and slogans are trademarks of Shopify. Other names and marks belong to their respective owners.
SECTION 8 — OPTIONAL AND THIRD-PARTY TOOLS
We may provide access to customization, preview, payment, analytics, customer support, or other tools supplied by third parties.
These tools may be provided on an “as available” basis and may be subject to the third party’s terms and privacy practices. We do not control every aspect of third-party tools and do not guarantee that they will always be uninterrupted or error-free.
Your use of optional tools is at your discretion. You should review any applicable third-party terms.
Any future features, tools, or resources introduced through the Services will also form part of the Services and will be subject to these Terms.
SECTION 9 — THIRD-PARTY LINKS
The Services may contain links to websites, materials, or features operated by third parties.
We are not responsible for evaluating the accuracy, security, content, or practices of third-party websites. If you leave our Services to access a third-party website, you do so at your own risk.
Please review the third party’s policies and terms before entering into a transaction. Questions or claims concerning third-party products or services should be directed to the applicable third party.
SECTION 10 — RELATIONSHIP WITH SHOPIFY
Emberena is powered by Shopify, which enables us to provide the Services. However, any sales and purchases made through our store are made directly between you and Emberena.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of a sale between you and Emberena, including any injury, damage, or loss arising from products or services purchased from us.
To the extent permitted by applicable law, you release Shopify and its affiliates from claims and liabilities arising directly from purchases from or transactions with Emberena.
SECTION 11 — PRIVACY
Personal information collected through the Services is governed by our Privacy Policy at https://emberena.com/policies/privacy-policy.
Certain personal information is also processed by Shopify. Shopify’s applicable privacy information is available at https://www.shopify.com/legal/privacy/consumers.
Because the Services are hosted by Shopify, information you submit may be transmitted to Shopify and other service providers, including providers located outside your country of residence, where necessary to operate the store, process payments, personalize products, produce and ship orders, provide support, prevent fraud, and comply with law.
Please review our Privacy Policy for more information about how photographs, personalization information, order information, and other personal data are handled.
SECTION 12 — FEEDBACK
If you voluntarily submit reviews, suggestions, ideas, comments, proposals, or other feedback about the Services (“Feedback”), you grant us a worldwide, perpetual, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback for legitimate business purposes.
This Feedback license does not apply to private Customer Content submitted solely for production of a personalized order. Customer Content is governed by Section 3 and our Privacy Policy.
You represent that you have the necessary rights to submit Feedback and that it does not infringe third-party rights or contain unlawful, defamatory, abusive, obscene, malicious, or misleading content.
We are not required to keep Feedback confidential, pay compensation for it, or respond to it, unless we expressly agree otherwise or applicable law requires it.
SECTION 13 — ERRORS, INACCURACIES, AND OMISSIONS
Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, personalization options, pricing, promotions, shipping charges, delivery estimates, or availability.
We may correct errors, update information, or cancel affected orders where reasonably necessary. If we cancel an order because of our error, we will refund the amount paid for the canceled portion.
SECTION 14 — PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to:
- • Violate any applicable law or regulation
• Infringe our rights or the rights of another person
• Upload content you do not own or have permission to use
• Upload exploitative, abusive, unlawful, hateful, sexually explicit, obscene, threatening, defamatory, deceptive, or otherwise harmful content
• Misrepresent your authority to submit a photograph or information relating to a child
• Harass, abuse, threaten, discriminate against, or harm another person
• Submit false, misleading, fraudulent, or impersonating information
• Transmit viruses, malware, malicious code, spam, phishing messages, or unauthorized advertising
• Collect or track another person’s personal information without authorization
• Scrape, copy, extract, resell, or commercially exploit the Services without permission
• Circumvent security, access restrictions, robot-exclusion measures, or technical safeguards
• Interfere with the operation or security of the Services
We may suspend or terminate access, refuse content, or cancel an affected order if we reasonably believe these Terms have been violated.
SECTION 15 — AGENTS AND AUTOMATED ACCESS
If you use or deploy software, artificial intelligence, or another automated or semi-automated agent to access or interact with the Services, the agent must accurately identify itself where technically required and must comply with these Terms.
An agent may not conceal that it is automated, imitate human behavior to bypass safeguards, evade CAPTCHA or access restrictions, provide false answers about whether it is automated, or circumvent measures designed to restrict automated access.
We may limit or block automated access where necessary to protect the Services, customers, systems, or rights holders.
SECTION 16 — TERMINATION
We may suspend or terminate your access to the Services if you materially violate these Terms, engage in fraud or unlawful conduct, threaten the security of the Services, or misuse our intellectual property or customization tools.
Termination does not remove payment obligations or liabilities that arose before termination.
Provisions that by their nature should survive termination—including intellectual property, Customer Content licenses required to complete accepted orders, Feedback, disclaimers, limitations of liability, indemnification, governing law, and privacy obligations—will continue to apply.
SECTION 17 — DISCLAIMER OF WARRANTIES
Information provided through the Services is for general informational purposes. We make reasonable efforts to keep it accurate but do not guarantee that all information will always be complete, current, or error-free.
To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not guarantee that the website or optional tools will always be uninterrupted, secure, timely, or error-free.
Nothing in these Terms excludes or limits any warranty, consumer guarantee, or other right that cannot legally be excluded or limited.
SECTION 18 — LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Emberena, Jiangxi Sinotrade Through International Logistics Ltd., our affiliates, personnel, contractors, service providers, licensors, and Shopify and its affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including loss of profit, revenue, savings, data, opportunity, or replacement costs arising from use of the Services.
Where liability cannot lawfully be excluded, our aggregate liability relating to a claim will, to the extent permitted by law, be limited to the amount paid for the product or order giving rise to that claim.
These limitations do not apply to liability that cannot be excluded or limited under applicable law, including mandatory consumer protections.
SECTION 19 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Emberena, Jiangxi Sinotrade Through International Logistics Ltd., Shopify, and our respective affiliates, personnel, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal costs arising from:
- • Your material breach of these Terms
• Customer Content that infringes another person’s rights
• Your violation of law or third-party rights
• Fraudulent, unlawful, or unauthorized use of the Services
We will provide reasonable notice of an indemnified claim and may control its defense and settlement, provided that we will not agree to a settlement imposing a non-monetary obligation on you without your reasonable consent.
SECTION 20 — SEVERABILITY
If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or separated from the Terms, and the remaining provisions will remain effective.
SECTION 21 — WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce a right under these Terms does not waive that right.
These Terms and the policies referenced in them constitute the entire agreement between you and us concerning use of the Services and supersede prior communications or agreements relating to the same subject matter.
SECTION 22 — ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
We may transfer or assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of service provider, or other legitimate business transaction, subject to applicable law.
SECTION 23 — GOVERNING LAW AND JURISDICTION
These Terms of Service and any separate agreements whereby we provide you with the Services shall be governed by and construed in accordance with the laws of the United Kingdom.
PAYMENT COLLECTION COMPANY
For payments collected through USEEMALL LTD, the payment collection company is:
Company Name: USEEMALL LTD
Company Address: Conyngham Road, Manchester, England (This is not a returning address).
USEEMALL LTD acts as a payment collection company, not as the operator of Emberena. For product, delivery, return, or refund enquiries, please contact Emberena using the contact details below.
Nothing in this section deprives a consumer of any mandatory protection or right to bring a claim in another forum where applicable law does not permit that right to be waived.
SECTION 24 — HEADINGS
Headings are included for convenience only and do not limit or otherwise affect these Terms.
SECTION 25 — CHANGES TO THESE TERMS
You may review the current version of these Terms on this page at any time.
We may update these Terms by publishing a revised version on the website. Where required by applicable law, we will provide notice of material changes.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the changes, except where applicable law requires additional consent.
